The request covers cash market size and liquidity, market oversight and manipulation concerns, customer protection standards, and the treatment of perpetual compute futures.
According to the CFTC's announcement, Chairman Michael S. Selig stated that "America cannot win the AI race without a robust derivatives market for compute," and described the request as "the first step toward establishing clear rules of the road for American compute markets." The agency positioned compute alongside historical commodity markets, with Selig noting that "just as American markets helped establish the gold standard for trading the commodities that powered the industrial economy, we will do the same for the commodity that will power the intelligence economy."
The request seeks comment on five specific dimensions: the size and liquidity of underlying compute cash markets, oversight mechanisms and manipulation safeguards, protections for derivatives customers, the structure and risks of perpetual futures contracts in compute, and other considerations the agency deems relevant to establishing a regulatory framework.
Comments will be accepted for 60 days following publication in the Federal Register, per the CFTC's announcement.
