Circle wins New York trust charter after OCC national bank approval

Circle Internet Group secured a limited purpose trust charter from the New York Department of Financial Services on July 31, completing a dual federal-and-state banking authorization structure for the USDC stablecoin operator. The state charter enables Circle to provide fiduciary, custody, and asset-management services under New York Banking Law, per CoinDesk's reporting.

The New York approval follows Circle's receipt of national trust bank authorization from the U.S. Office of the Comptroller of the Currency earlier in July. National trust banks are authorized to provide users with custody and fiduciary services but do not accept consumer deposits or make loans like traditional commercial banks, according to the sources. Circle stated that the national bank would enhance safety and regulatory oversight of the USDC reserve while enabling the firm to offer fiduciary digital asset custody to institutional customers.

Circle CEO Jeremy Allaire said in a statement, per CoinDesk, that earning the New York trust charter had been a longstanding objective given the regulatory clarity it provides. The firm was the first company to receive a BitLicense from the NYDFS nearly six years ago. Several other crypto firms have since secured the limited purpose trust charter from NYDFS, including Coinbase, Moonpay, Bitgo, and Paxos, per CoinDesk's reporting.

Circle's stock price stood at $64.24 on the morning of the announcement, while USDC carries a market capitalization exceeding $71.8 billion, according to CoinDesk. The dual licensing structure positions Circle alongside Tether as a regulated stablecoin infrastructure provider, though the two firms differ substantially in reserve composition and disclosure practices.
