SEC Proposes Crypto Self-Custody Framework for Investment Advisers (October 1, 2026)

The SEC issued a proposal under the Investment Advisers Act and Investment Company Act that would permit registered investment advisers and funds to self-custody crypto assets under certain conditions, allow state trust companies to serve as custodians, and update audit and custodial service rules. A 60-day public comment period will follow publication in the Federal Register.

The SEC has proposed a custody framework that would permit registered investment advisers and funds to self-custody crypto assets or use state trust companies as custodians, replacing years of regulatory ambiguity that kept institutional players sidelined. The proposal, issued under the Investment Advisers Act of 1940 and Investment Company Act of 1940, updates rules around financial-statement audits for advisers and broker-dealer custodial services for funds.

Advisers have long been required to keep client assets with "qualified custodians" that meet strict safekeeping standards, according to Decrypt. The uncertainty over which crypto arrangements satisfy that standard has created a compliance gap. The new proposal establishes conditions under which self-custody is permissible and sets conditions for state trust company custody arrangements.

SEC Chairman Paul Atkins framed the move as overdue. "Since the advent of Bitcoin in 2008, the crypto asset market has grown from a niche curiosity into a multi-trillion-dollar asset class to which investors actively seek exposure," Atkins said, per Decrypt. He added that the agency's rules "have not kept pace" and the proposal would replace "the grey of uncertainty created by custody rules crafted for a bygone era."

Friday's crypto calendar compressed multiple structural developments into a single session. The SEC issued a proposal on October 1 to establish tailored custody standards for registered investment advisers and regulated funds holding crypto assets. Per the desk's reporting, the proposal permits self-custody under certain circumstances and allows state trust companies to serve as custodians, replacing years of regulatory ambiguity that blocked institutional participation. The framework amends rules under the Investment Advisers Act of 1940 and the Investment Company Act of 1940. A 60-day public comment period will follow publication in the Federal Register, meaning the timeline to finalized rules depends on comment volume and substance; final rules may differ materially from the proposed version.

On the capital-markets side, Evernorth cleared a shareholder vote on September 30 and is set to list on Nasdaq on October 8 under ticker XRPN. As the desk reported Thursday, the Ripple-backed treasury company is entering public markets with approximately 473 million XRP, the largest publicly traded pure-play XRP treasury by its own assessment. The combined entity generated more than 1 billion dollars in total funding, comprised of roughly 300 million dollars in gross cash proceeds from private placements, convertible notes, and trust proceeds. Evernorth's stated strategy differs from passive spot ETFs: it plans to deploy its XRP holdings across DeFi protocols and arbitrage opportunities on the XRP Ledger ecosystem to compound the asset base, introducing both operational execution risk and liquidity constraints absent from custody-only vehicles.

In cross-border settlement, Lloyds Banking Group and Visa executed a live pilot Friday transferring $750,000 in USDC from Jersey to the US in under an hour, including weekend processing. The seven-day trial used Canton blockchain infrastructure on Lloyds' end and separate Visa blockchain rails, per desk reporting. The settlement demonstrates a working institutional model for stablecoin movement across borders on blockchain rails, bypassing traditional correspondent banking that typically requires multiple days and intermediaries. Weekend capability signals systems built outside standard banking hours.

On sanctions enforcement, the Treasury designated Russia's A7 Network as a transnational criminal organization on October 1 and proposed prohibiting transmittal of funds involving its Sub-Agents. The network moved $179.1 billion in A7A5, a ruble-backed token, between February 2025 and June 2026, while processing more than $17 billion in dollar transactions. Promsvyazbank, Russia's state-owned defense bank, holds the token deposits. The rule binds roughly 348,000 institutions globally, including crypto exchanges. A7A5 runs on Tron and Ethereum blockchains, however, meaning effectiveness depends on exchange compliance rather than technical barriers; the network has already shifted supply to unhosted wallets following the Grinex hack, suggesting adaptation to regulatory pressure.

Separately, the UK Financial Conduct Authority opened its authorization gateway for the new crypto regime on September 30, creating a narrow window for existing platforms. Firms have until February 28, 2027 to file if they want to preserve the right to take new business after the regime's October 25, 2027 launch. An application filed by that deadline allows continued service to new and existing customers if the application remains pending when commencement occurs; the statutory protection lasts two years, expiring October 25, 2029. Platforms that miss the deadline face mandatory run-off: no new business with any UK customer from October 25, 2027 forward.

On tape, price movement was mixed. Bitcoin closed down 0.4% on the day, though up 15.7% over the month; per the desk's Whale Watch board, $223,410 in bitcoin moved off exchanges over the last 24 hours, continuing a weekly pattern, the week ending October 2 saw $840 million move onto exchanges. Bitcoin ETF flows came in positive: $2.4 million on October 2, with $53.6 million net inflow over the last five sessions. XRP fell 0.9% on the day and 5.8% over the week, though it is up 16.8% on the month; funding rates on XRP shorts are deeply negative at -13.3% annualized on OKX, reflecting heavy long positioning. Fear and Greed sits at 72, in Greed territory.
