SEC Freezes Nasdaq Bitcoin Options Approval in Jurisdictional Showdown With CME

The SEC has paused Nasdaq's approval of cash-settled bitcoin index options (QBTC) and will reconsider the decision following a legal challenge from CME Group. CME argues bitcoin is a commodity under CFTC jurisdiction, not SEC authority. Interested parties have until August 24 to submit statements on the matter.

The SEC has paused its May approval of Nasdaq's cash-settled bitcoin index options, known as QBTC, and will conduct a full commission review after CME Group challenged the agency's authority to oversee the product. The dispute hinges on a fundamental question: whether bitcoin derivatives fall under SEC or CFTC jurisdiction.

CME filed its challenge on June 11, and the stay has remained in place since then. According to CoinDesk's reporting, CME argues that bitcoin is a commodity, not a security, and therefore options tied directly to its value fall under the CFTC's exclusive jurisdiction. If CME prevails, the SEC would lose authority to approve QBTC entirely, forcing Nasdaq either to register as a CFTC-regulated futures or swaps venue or redesign the contracts to track a security such as a spot bitcoin exchange-traded fund.

Nasdaq's May approval envisioned the CFTC granting exemptions that would allow Nasdaq and the Options Clearing Corporation to offer the product through the securities market. CME contested this approach, arguing that agencies cannot use exemptions to transfer regulatory authority from one regulator to another. CME also warned that the approval could set a precedent allowing securities exchanges to list derivatives on other commodities, potentially fragmenting oversight.

The Afternoon Brief 6:15 PM UTC

Bitcoin traded near $62,679.77 on the desk's board as of August 1, down 0.22% on the day and 5.14% over the past week, with the Fear and Greed Index reading 27, within its recent 20-to-33 range. That backdrop framed a day in which regulatory friction widened rather than narrowed: the SEC froze its own May approval of Nasdaq's cash-settled bitcoin index options (QBTC) after CME Group challenged the agency's jurisdiction, arguing bitcoin derivatives belong exclusively to the CFTC, per CoinDesk's reporting. Interested parties have until August 24 to file statements, the desk reported.

That jurisdictional question echoed elsewhere. New York sued Kalshi on July 31, alleging the prediction-market platform runs an unlicensed gambling business despite its federal CFTC license, seeking triple damages plus $100,000 per unauthorized wager offer, according to Attorney General Letitia James's filing as reported by the desk. Separately, the U.S. Treasury sanctioned two Iranian maritime insurance entities, Persian Gulf Marine Insurance Company and HormuzSafe Marine Services Authority, for accepting Bitcoin to bypass sanctions on shipping through the Strait of Hormuz, per Treasury's own statement. A related story detailed a $4 billion Iran sanctions-evasion scheme routed through the unlicensed Dubai exchange Shelbit into major platforms including Binance, per investigative reporting cited by the desk.

On the corporate and market side, Circle completed a dual federal-and-state banking structure, adding a New York limited purpose trust charter on July 31 to the OCC national trust bank authorization it received earlier in July, the desk reported. Coinbase's Q2 results told a weaker story: $1.22 billion in revenue and $208 million in adjusted EBITDA, missing analyst expectations even as the exchange captured a record 10.3% share of global crypto trading volume, per CoinDesk. Tether posted $1.5 billion in Q2 operating profit, down 69% from $4.9 billion a year earlier, while its reserve buffer fell to $4.11 billion from $8.23 billion the prior quarter, even as USDT issuance grew by about $446 million to $184.6 billion, according to a BDO attestation cited by the desk.

A security story added a different kind of risk: Coinkite told Coldcard owners that seeds generated across current firmware versions relied on a software fallback rather than the hardware random number generator, and that updating firmware does not repair a seed already created. Decrypt, cited in the desk's reporting, put losses at 594 BTC drained from roughly 500 wallets within 25 minutes, though Coinkite's own advisory does not state a figure.

The reporting attributes Coinbase's miss to subdued spot trading volumes and depressed prices squeezing transaction revenue, its largest line item. Tether's profit decline and reserve drawdown are reported as facts without the desk's reporting stating a specific cause beyond the quarter's asset-value declines in the gold and bitcoin it added to reserves. The SEC-CME dispute and the Kalshi suit both turn on the same underlying question, which regulator holds authority over crypto-adjacent products, though the reporting does not say when either will resolve.

The desk's Whale Watch board shows $77,223,303 net moving off exchanges over the past 48 hours, driven by $85,856,699 in bitcoin net outflows, with the largest single move $157.5 million in BTC leaving Coinbase. Ether ran the other way, with $8,633,396 net moving onto exchanges, led by $68.3 million into Coinbase Institutional, countering the broader withdrawal trend. Leverage data shows OKX bitcoin liquidations over the past 23 hours at 233 total, $1,020,722 in longs against $392,824 in shorts, with funding positive on bitcoin (+0.0044% per 8 hours, annualized 4.8%) and Solana (+0.0034%, annualized 3.7%). ETF flows diverge by asset: bitcoin ETFs saw a net outflow of $265.4 million on July 31, part of a five-session net outflow of $61.5 million with only one day matching that direction, while ether ETFs took in $9.0 million that same day, contributing to a $10.0 million five-session net inflow across two consecutive same-direction days.

Ahead, the CLARITY Act faces an August 8 date per the desk's regulatory tracking, and the SEC's QBTC review carries an August 24 comment deadline. Coinkite has said a formal technical review is coming, which would clarify how many wallets remain exposed. South Korea's crypto tax implementation remains set for January 1, 2027, per the desk's prior reporting.
